The London Spanish Book and Zine Fair 2019 Terms and conditions.
1- Introduction
These terms and conditions (‘Terms and Conditions’) apply to the sale to you (‘the Exhibitor’) by LSBF – LA TUNDRA of exhibition tables at the London Spanish Book & Zine Fair 2019 (‘LSBF’).
2- Acceptance of placement
Persons, companies and organisations wishing to participate in the LSBF must confirm their involvement with the relevant payment of the fees.
3- Terms of Payment and acceptance of participation
The authors and publishers approved by LSBF will receive an invitation by e-mail.
Prior to the LSBF (Early birds must be paid in full by 26th July 2019), the Exhibitor will receive an invoice requesting the payment for the exhibition table. If payment is not received before the LSBF, it will not be possible for the Exhibitor to take part in the fair
Fees are non-refundable. If the LSBF 2019 is cancelled (see 18 -Force Majeure), LSBF will return your fees in full but cannot be held liable for any additional expenses incurred.
4- Exhibitors Table allocation
Exhibitors table allocation will be confirmed after payment of fees. Exhibitors cannot sublet their space and are non-transferable.
Independent authors must apply for a half table only (the other half table will be occupied by another independent author selected by LSBF).
Publishers and collectives (+3 writers) must apply for a full table. (Please refer to tables prices and conditions).
Fanzine makers can apply for a half table (not more than 2 authors sharing) or to participate at the Fanzine collective table (conditions apply).
LSBF reserve the right to move any table allocation if needed.
5- Move in- Move out periods
Exhibitors must ensure that their tables are occupied without interruption during the opening hours of the LSBF as follow:
Friday 4th October 1 pm to 7 pm
Saturday 5th October 11 am to 6 pm
Access to the fair: Exhibitors will access to the venue on Friday 4th October at 1 pm and will have one (1) hour to set up their tables prior to opening the fair to the public. Tables must be ready before opening to the public on Friday 4th October at 2 pm.
End of the fair: Exhibitors will need to dismount their table on Saturday 5th October between 5 pm and 6 pm,and nor table can be dismounted earlier than the public closing time of the fair. Exhibitors must vacate the venue on Saturday 5th October by 6pm or may be charged £ 50.- per hour.
6– Sound and nuisance
Is not permitted the use of any equipment (including mics), the holding of any event or the giving of any performance that causes an obvious nuisance to adjacent exhibitors or visitors unless agreed by prior arrangement with LSBF.
Exhibitors must not cause a visual, acoustic or spatial nuisance to neighbours, nor impede the circulation of visitors in passageways.
Exhibitors cannot offer or sell food at their tables.
7- Waste and cleaning
Exhibitors must take care its own waste and rubbish during and after the fair. There will not be a service of cleaning the tables and exhibitors must keep the tables tidy at all times.
8- Signage
Signage for each table will be provided by the LSBF.
It is not allowed to have banners on the centre aisle tables. Exhibitors are encouraged to cover their tables with fabric or any other material to make their products look orderly and presentable. If the Exhibitor has a specific technical request it would need a written approval by LSBF.
9- Storage
Storage, boxes and any other kind of packaging must be kept under the tables at all times. It is not possible to send deliveries to the venue prior to the day of opening of the fair and time for mounting the tables. The organiser will not be responsible for undelivered or damaged goods ordered by the exhibitor.
10– Advertising
Advertising is only possible at the allocated table. Flyer distribution is not allowed unless written permit by LSBF.
11- Parking
Parking facilities are not available at the venue.
12- Liability for exhibits and table operation
The Exhibitor is liable for their exhibit and table operation at all times. The Exhibitor takes full responsibility for any good left overnight and after closing times. LSBF will not be liable to any loss or damage.
13- Liability for auxiliary personnel
The Exhibitor is liable for any damage caused by auxiliary delegates engaged by the Exhibitor.
14- Liability of the LSBF
The LSBF shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, for any loss of profit or any indirect special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of the LSBF, its employees, agents, sub-contractors or otherwise) which arise out of or in connection with the sale of the LSBF table or its use by you and the entire liability of the LSBF under or in connection with the sale of the LSBF table to you shall not exceed the total sum paid under the final invoice.
15- Complaints Any complaints by the Exhibitors must be submitted, with the intention of a friendly resolution to LSBF by registered letter or official email postmarked no later than 15 days after the closing of the fair. Any complaints received after this date will not be recognized.
16- Insurance
All Exhibitors are requested to insure all exhibits and table installations against fire and damage by the forces of nature and must also conclude a third party liability insurance. In addition, Exhibitors are advised also to insure exhibits and stand installations against damage and loss during the LSBF and during transport to and from the event.
17- Data Protection
The LSBF’S data policy follows the GDPR General Data Protection Regulation (EU) 2016/679. The legal basis for this is to fulfil a contract, meaning to ensure that you correctly receive the product you have purchased. We will use your data to ensure that we continue to provide a high-quality service using legitimate interest as a legal basis. With your consent we will email you regarding London Spanish Book & Zine Fair. Your personal data will not be shared further by the LSBF.
18- Force Majeure
Neither party is responsible for any failure to perform its obligations under this contract, if it is prevented or delayed in performing those obligations by an event of force majeure
In the presence of any good and sufficient cause, third-party default, accidental happening, political and economic events, and orders by authorities, LSBF has the right to postpone the event, shorten or prolong its duration, cancel it, or adapt its operation to circumstances.
In all such cases, the LSBF rejects any liability, and the Exhibitor will not be entitled to claim compensation. Payments already made will be reimbursed after the deduction of the costs and expenses already accrued by the LSBF. For the purposes of this clause, an accidental happening is defined as any unforeseeable circumstance not attributable either to the LSFB or to the Exhibitor, and will include any act of force majeure.
19- Governing Law
These Terms and Conditions shall be governed by and construed in accordance with English law and the parties irrevocably submit to the non-exclusive jurisdiction of the English courts. Nothing contained in these Terms and Conditions affects your statutory rights.
20- Unforeseen occurrences
In the event of any occurrences not foreseen in these Terms and Conditions, the decision of the organizer LSBF shall be final.
